What do we offer?
COMINTY publishes and operates the Cominty platform (the "Platform"), the purpose of which is to enable companies to ask questions on a specific topic to a chatbot.
COMINTY allows you to ask your questions on specific topics to a conversational agent (the "ChatBot"). The ChatBot provides you with information generated by artificial intelligence, based on the Client's internal documents and data, information from the internet, and the fundamental knowledge of the artificial intelligence model used, in order to provide you with an answer.
The Services are offered through the Platform. You have access to the Platform under the contract concluded between COMINTY and your organization (the "Organization") which allows you to benefit from our Services (the "License Agreement").
These general terms of use (the "General Terms") grant an individual user ("User", "you") an individual right of access to and use of the Platform and the Services, within the framework of the License Agreement concluded between your Organization and COMINTY.
How to access our Services?
To access our Services, your Organization must have invited you to create an account on the Platform and complete the form provided for this purpose on the Platform.
You must provide us with all information marked as mandatory.
Registration automatically leads to the opening of an account in your name (the "Account"), which allows you to access our Services using your login ID and password. Once your Account has been opened, you have access to a personal space allowing you to manage the use of the Platform.
What are our Services?
The Services to which you have access are described in the License Agreement. You can view the features of our Services directly on our Platform.
COMINTY reserves the right to offer any other Service it deems useful, in a form and according to the functionalities and technical means it deems most appropriate to provide said Services.
Fair Use Policy
1. Principle
In order to ensure consistent service quality for all users and preserve the stability, security and performance of the Platform, COMINTY implements a Fair Use Policy (the "Fair Use Policy").
The Fair Use Policy applies to any License Agreement that does not expressly stipulate a contractual volume of requests, storage, or feature usage. Where the License Agreement stipulates such a volume, its provisions shall prevail.
2. Usage limits and technical safeguards
The use of the Platform by each User and by the Organization is subject to reasonable usage limits and technical safeguards, set at COMINTY's reasonable discretion, which may apply notably to:
- the number of requests made per session, per day, per week, or per month;
- the volume and complexity of data processed per request, including message length, file size, number of attached files, and conversation length;
- access to certain artificial intelligence models or specific features, including advanced mode, autonomous agents, parallel processing, and third-party integrations;
- the processing speed of requests, including latency, throughput, and parallelism;
- the number of simultaneous or automated requests;
- the storage volume allocated per User or per Organization.
These limits may vary over time depending on the model or feature used, the volume and complexity of the data processed, the Platform's load, and COMINTY's operational requirements.
COMINTY is not required to disclose fixed numerical thresholds for each limit, provided that the Fair Use Policy and the types of usage restrictions that may apply have been notified to the Organization in accordance with these General Terms.
COMINTY may provide information on applicable usage limits or consumption levels through any written means, including email, in-Platform notifications, product documentation, or the Platform interface, where such information is technically available.
3. Initial implementation and subsequent adjustments
The initial implementation of the Fair Use Policy with respect to an Organization, where its License Agreement did not provide for any usage limit at the date of signature, shall be notified by COMINTY at least thirty (30) calendar days prior to its effective date.
Once the Fair Use Policy is in force, subsequent adjustments to the usage limits or technical safeguards may be made by COMINTY at its reasonable discretion and notified to the Organization by any written means, including email, in-Platform notification, product documentation, or update to these General Terms.
Where an adjustment materially affects the Organization's use of the Platform, COMINTY will use reasonable efforts to provide prior notice, except in the event of security risk, manifest abuse, unauthorized automation, abnormal usage, critical overload, or threat to the stability, security or performance of the Platform, in which cases the relevant measures may apply immediately.
4. Measures applicable in case of overage, abnormal usage, or platform risk
In the event of overage, abnormal usage, disproportionate consumption of Platform resources, manifest abuse, unauthorized non-human use, or threat to the stability, security, or performance of the Platform, COMINTY reserves the right, without such measures constituting a breach of its contractual obligations:
- (i) to apply a temporary and progressive limitation of the request processing speed ("Throttling"), without complete interruption of the service;
- (ii) to temporarily restrict access to certain models or features, including by switching to a less resource-intensive model;
- (iii) to limit the number of simultaneous or automated requests;
- (iv) to propose to the Organization an upgrade to its plan;
- (v) in the event of manifest abuse, unauthorized non-human use, scraping, non-contractual automation, looping requests, security risk, or threat to the stability of the Platform, to immediately suspend access to the affected account(s), with prior warning where circumstances reasonably allow.
COMINTY shall apply such measures in a proportionate manner, taking into account the nature of the usage, the impact on the Platform, and the need to preserve service quality for all users.
5. Preventive information
Where technically available, COMINTY may provide the Organization or its Users with information relating to their usage levels through the Platform interface, in-Platform notifications, email, or any other written means.
Such information is provided for transparency purposes only and shall not constitute a condition precedent to the application of the Fair Use Policy, including Throttling or other technical safeguards in case of overage, abuse, abnormal usage, unauthorized automation, or threat to the stability, security, or performance of the Platform.
6. Articulation with the availability guarantee
The application of the Fair Use Policy does not constitute either an unavailability or a breach of COMINTY's obligations relating to the availability of the Platform as defined in the License Agreement. The contractual availability guarantee covers the accessibility of the service and not its throughput, processing speed, access to a specific AI model, or specific feature.
The Platform shall be deemed available as long as Users can access it and submit requests, even in degraded mode, except in cases of suspension justified by manifest abuse, unauthorized non-human use, security risk, or threat to the stability of the Platform.
What data is used to feed the ChatBot?
When using the Platform, there are several possible data sources, which can be combined or used individually, to feed the ChatBot so that it may formulate a response to your question.
Your Organization can upload documents in bulk or individually directly to the Platform, allow COMINTY to retrieve them or send them to COMINTY, or connect data from the Organization's internal tools, such as CRMs or any other company information system.
You can upload one or more documents yourself directly to the Platform.
How is artificial intelligence used by COMINTY?
The Services rely on the use of artificial intelligence systems in several respects:
- To collect and process the data provided;
- To transmit processed information via a conversational agent;
- To determine the professionals to whom to refer you;
- This list is not exhaustive.
We ensure that our use of artificial intelligence tools is consistent with the commitments we have made under our AI Compliance Charter.
For how long do you have access to our Services?
You can use our Services for the duration subscribed to by the Organization within the framework of the License Agreement.
Financial conditions
You can access our Services subject to the payment of the price by your Organization in accordance with the License Agreement.
License Features
You benefit from a non-exclusive, personal, and non-transferable right to operate a license in SaaS mode for the use of the Platform for the duration specified in the article "For how long do you have access to our Services?".
You are not authorized to:
- reproduce, modify, decompile, adapt all or part of the Platform, or perform any form of reverse engineering;
- engage in any form of commercial exploitation of the Platform with third parties;
- assign, provide, lend, lease the Platform, or grant sub-licenses or other usage rights;
- integrate all or part of the Platform into any computer system or software solution;
- tele-transmit the Platform, network it, or distribute it without written authorization.
Intellectual property rights
Intellectual property rights on the Platform
The Platform is our property, as are the software, infrastructures, databases, and content of all kinds (texts, images, visuals, music, logos, trademarks, etc.) that we operate. They are protected by all applicable intellectual property rights or database producer rights. The license we grant you does not entail any transfer of ownership.
Consequently, any disassembly, decompilation, decryption, extraction, reuse, copying, and more generally any acts of reproduction, representation, dissemination, and use of any of the elements composing the Platform, in whole or in part, without our authorization, are strictly prohibited and may be subject to legal proceedings.
Intellectual property rights on documents and data
The Organization's data used to feed the ChatBot is the property of the Organization. It is protected by all intellectual property rights. However, for the proper functioning of the Services, the Organization expressly authorizes us to decrypt, extract, reuse, copy, and reproduce the data transmitted by the Client to feed the ChatBot.
Intellectual property rights on Content and testimonials
By subscribing to the Services, you acknowledge that the content of all kinds that you publish on the Platform (the "Content") is disseminated in a spirit of community exchange.
Testimonial Usage Rights (10 years):
- free dissemination on the Platform and partner websites;
- promotion across any medium;
- translation into any language;
- format modifications for technical constraints;
- no remuneration claims.
Any testimonial containing personal data may be subject to withdrawal requests via hello@cominty.ai.
Use of personality attributes
As part of the promotional operations that we may implement to promote our Services, you authorize COMINTY to fix, reproduce, disseminate, and communicate to the public, in excerpt or in its entirety, your personality attributes, namely your image, your first name, and your voice (the "Personality Attributes").
This authorization is granted worldwide for 10 years across all media types for promotional purposes. COMINTY cannot exploit your attributes in ways that harm your reputation.
Your obligations and responsibilities
Regarding your Account
You are responsible for maintaining the confidentiality and security of your login ID and password. Any unauthorized use must be reported immediately to COMINTY.
Regarding data source for feeding the ChatBot
You can feed the ChatBot by uploading documents directly to the Platform. You expressly authorize this use of the data and documents that you transmit to us.
Your guarantees:
- the Organization holds all rights to transmitted documents;
- the documents do not constitute infringement;
- nothing obstructs free exploitation by COMINTY;
- you indemnify COMINTY against any claims.
Regarding the use of Services
Permitted use:
- personal use only;
- report security threats;
- follow platform guidelines.
Prohibited activities:
- illegal or fraudulent activity;
- harming public order;
- reverse engineering;
- commercial exploitation.
Content responsibility
You are responsible for all Content published on the Platform. Content is public by default and visible to other users.
Content must not:
- violate public order or morals;
- infringe third-party rights;
- be false or misleading;
- harm computer systems;
- promote illegal activities;
- be defamatory or abusive.
What is our responsibility?
We undertake to provide the Services with diligence and according to the rules of the art, under an obligation of means, to the exclusion of any obligation of result.
Our commitments:
- regular platform functionality checks;
- sufficient storage capacity;
- data security measures;
- infrastructure protection.
Limitations:
- no guarantee of error-free service;
- standard service, not customized;
- external network issues excluded;
- force majeure events excluded.
Personal Data Processing
We process your personal data as a data controller within the meaning of applicable regulations. Our Privacy Policy is accessible on our website.
Hosting and Maintenance
Hosting: We ensure hosting of Platform content in accordance with professional practices and state of the art, implementing all necessary technical security measures.
Maintenance: Any anomaly detected by Users must be reported to the Organization, which handles processing directly with us.

Hours: Monday to Friday, 9 AM to 6 PM, excluding holidays.
Links and Third-Party Sites
We are not responsible for the technical availability, content, or services of third-party websites accessible through the Platform. We are not party to disputes between users and third parties.
Agreement on Proof
You acknowledge that data collected on the Platform constitutes proof of operations and is the primary mode of evidence between parties.
Service Termination
User Initiated: request unsubscription directly to your Organization at any time.
Organization Initiated: Organization may request your unsubscription at any time.
Sanctions for Breach of Obligations
Obligations constitute essential terms. In case of breach, we may:
- suspend or delete access;
- delete related content;
- publish information messages;
- notify competent authorities;
- initiate legal action;
- claim damages.
Modification of General Terms
COMINTY may amend these General Terms at any time.
Any amendment will be notified to the Organization by any written means, including email, with a minimum prior notice of thirty (30) calendar days before the effective date, where such amendment materially affects the Organization's or Users' rights or obligations.
Continued use of the Platform by the Organization and its Users after the effective date constitutes acceptance of the amended General Terms.
Should an amendment materially affect the essential terms of the License Agreement, the Organization may contact COMINTY within fifteen (15) calendar days of receipt of the notification to discuss its situation. Where required by applicable law or the License Agreement, the Organization may terminate the License Agreement without penalty within such period, subject to payment of all sums due for services actually consumed until the termination date.
Governing Law and Jurisdiction
These General Terms are governed by French law. Disputes will be settled amicably or submitted to the exclusive jurisdiction of Paris courts after one month of failed negotiations.
